Terms of Service
These terms govern your use of ViaductCDN, a privacy-first content delivery network operated by Inertial Navigation LLC, a Washington limited liability company. By creating an account or using the service, you agree to these terms. They’re written in plain English on purpose. If something is unclear, email legal@viaductcdn.com.
This is version 1. We reserve the right to revise. We’ll announce material changes in your in-portal notification feed and, where we have an email on file, by email. The current version is always at /terms; an effective-date stamp at the top tracks each revision. We will not retroactively apply more restrictive terms to your existing service without notice.
1. The service
ViaductCDN delivers content from your origin servers to your visitors, optionally via Tor hidden services (.onion) for operator and reader anonymity. We offer three plans: Free, Pro ($39/month), and Business ($499/month). Plan-specific limits and features are enumerated on /pricing; differences are summarised in the appendix at the end of these terms.
2. Your account
Account creation
Two signup paths exist:
- Email signup: standard email + password flow. We use the email for password reset, billing notices, and operational alerts.
- Anonymous signup: no email collected. We generate a tenant handle and a 12-word recovery phrase, both shown once on signup. The recovery phrase is the only authentication credential and the only way to regain access to a forgotten-password account.
If you lose your recovery phrase, your account is gone. We do not custody the phrase, cannot reset it, and cannot recover the account by any means. This is a deliberate trade-off for anonymity. Save your recovery phrase the moment we show it to you.
Account responsibility
You are responsible for all activity on your account, including activity by anyone who has your password, recovery phrase, or active session. Tell us immediately if you suspect compromise: security@viaductcdn.com.
3. Acceptable use
Our acceptable-use policy is at /abuse and is incorporated into these terms by reference. In short:
- We will act on credible, evidenced reports of CSAM, direct violence threats, active malware distribution, doxing, and lawful orders.
- We will not act on political disagreement, lawful speech, or unsubstantiated complaints. Copyright disputes go to the operator first, not us.
- Site suspension is the standard remedy. Operators receive 72-hour notice for non-urgent matters and immediate suspension (within 60 seconds) for clear violations.
4. What we see, what we log
We are a TLS-terminating CDN. Bytes flowing through our edge are visible to us in plaintext while in transit, including request URLs, headers, cookies, request bodies, and response bodies. This is the same trust position you give to Cloudflare, Fastly, or any other CDN that terminates TLS. We are unusually honest about it.
Our policy commitments about logging:
- We do not log request or response bodies.
- We do not log client IP addresses.
- We do log request metadata (URL path, status code, byte count, response time) for billing, capacity planning, and abuse triage. Default retention: 90 days.
- We log administrative actions on your account (sign-ins, configuration changes, billing events) in our audit log. Retention: 7 years, in line with US business-records norms.
- Cryptocurrency deposit records (Bitcoin and Monero invoice IDs, confirmation timestamps, on-chain transaction IDs) are retained 10 years, per US Anti-Money-Laundering recordkeeping norms even though we are not a money services business.
Full details, including the list of third-party processors (SendGrid for email, Stripe for cards, BTCPay for cryptocurrency, Microsoft Azure for infrastructure, Let’s Encrypt for TLS certificates), are on /privacy.
5. Payment
Free tier
No payment required. Hard egress cap (10 GB/month); service stops when the cap is reached and resumes at the start of the next calendar month.
Card payment (Pro and Business)
Monthly subscription billed via Stripe. We never see your card details; Stripe handles the payment side. Failed payments trigger Stripe’s standard retry sequence followed by service suspension if unresolved.
Cryptocurrency payment (Pro and Business)
Pay-as-you-go from a prepaid balance, topped up via Bitcoin or Monero invoices. Service stops immediately when the balance reaches zero. There is no grace period. This is a deliberate design: a hard stop preserves the privacy promise (no credit relationship to chase, no collections process to surface identifying information). Top up before you run out.
Refunds
For card payments: prorated refunds for the unused portion of a billing cycle on cancellation, on request, within 30 days. For cryptocurrency deposits: not generally refunded, because we do not collect the identifying information needed to verify a refund recipient. Specific operational issues (extended unplanned outages, billing errors) are addressed on a case-by-case basis at billing@viaductcdn.com.
6. Service availability
Free and Pro plans are best-effort with no formal SLA. Business plan has a 99.9% monthly edge-availability service-level objective; a formal SLA with credits is on the roadmap. SLOs cover ViaductCDN edge availability and do not cover availability of the Tor network itself, your origin, or third-party DNS.
7. Termination
By you
Cancel any time from the Account page. We delete your tenant data on cancellation; the audit-log retention listed in section 4 still applies.
By us
We may suspend or terminate your account for:
- Violations of the abuse policy (see /abuse).
- Unpaid billing past Stripe’s retry sequence, or zero crypto balance.
- Lawful orders compelling termination. We push back on overbroad orders; transparency report at /transparency.
- Activity that creates a clear and immediate risk to the integrity or security of the service or other customers (e.g., using the service to attack ViaductCDN itself, or another customer’s site).
8. No warranty
We provide ViaductCDN as-is. We do not warrant fitness for a particular purpose, uninterrupted operation, perfect security, perfect uptime, or any specific performance level beyond what is in your plan’s SLO if applicable. Use of the service is at your own risk.
9. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim arising from your use of the service is limited to the greater of (a) the amount you have paid us in the 12 months preceding the event giving rise to the claim, or (b) one hundred US dollars. We are not liable for indirect, consequential, special, incidental, or punitive damages, including lost profits, lost data, or business interruption, even if advised of the possibility of such damages.
10. Indemnification
You agree to indemnify and hold harmless Inertial Navigation LLC, its members, and its agents from any third-party claim arising out of your content, your violation of these terms, or your violation of any law, to the extent permitted by law.
11. Governing law and disputes
These terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-laws principles. Any dispute arising from these terms or the service shall be brought exclusively in the state or federal courts located in King County, Washington, and you consent to personal jurisdiction in those courts.
Service of process: Inertial Navigation LLC, 626 NW 87th St, Seattle, WA 98117, USA.
12. Changes to these terms
We may revise these terms. Material revisions will be announced via in-portal notification and, where applicable, email, at least 14 days before they take effect. Continued use of the service after the effective date constitutes acceptance of the revised terms. If you don’t agree to a revision, you may cancel your account before the effective date.
Appendix: Plan differences
The differences between Free, Pro, and Business plans:
- Free: .onion-only delivery, no clearnet, no custom domains, 10 GB egress hard cap (service stops on cap; resumes next month), 3 sites maximum.
- Pro: clearnet + .onion delivery, custom domains with Let’s Encrypt, vanity .onion, signed URLs, 250 GB egress ($0.06/GB overage), 25 sites.
- Business: 99.9% monthly availability SLO, OnionBalance backend replicas, 90-day default log retention, Tor-egress routing, 5 TB egress ($0.04/GB overage), 100 sites.
Anonymous-tier (no-email) accounts are available on any plan as long as payment is by cryptocurrency. Card payments require an email on file (Stripe’s requirement, not ours).
